Navigating North Carolina Workers Compensation Laws

In the specialized trucking world, understanding the legal requirements can be complex and often confusing.  However, maintaining compliance with these laws is essential to ensure the smooth operation of your Motor Carrier client's business and to provide peace of mind for all involved parties.  One such requirement that demands our attention is Workers Compensation Insurance in North Carolina.


Who Needs Workers Compensation Insurance?


According to North Carolina law (N.C. Gen. Stat. § 97-19.1), Workers Compensation coverage must be in place for certain Owner Operators, even if they are classified as Independent Contractors.  This requirement isn't limited to large companies; it applies irrespective of whether the principal contractor, intermediate contractor, or subcontractor regularly employs three or more employees.


So, what does this mean for Motor Carriers based in North Carolina?  Simply put, if an Owner Operator does not have Workers Compensation coverage, the responsibility to provide it falls on the Motor Carrier.


Exceptions to the Rule


With every rule, there are exceptions, and the same applies to the requirement of Workers Compensation Insurance.  A Motor Carrier is not liable for injuries to an Owner Operator who is individually licensed by the U.S. Department of Transportation (i.e., holds their own authority) and personally operates the vehicle.


While this may seem like a slight distinction, it can make a significant difference in the responsibilities of a Motor Carrier.
