As an insurance professional, it is essential to stay informed about the licensing requirements set by the state's Department of Insurance for various lines of business.  This ensures that you remain compliant with regulations and avoid potential penalties.  In this blog post, we will discuss the importance of possessing the necessary licenses for Accident & Health (A&H) and Property & Casualty (P&C) lines of business at both the producer and agency levels.  We will also address the misconception that some insurance companies or wholesale agents do not require an A&H producer's license when placing Occupational Accident Insurance.


State Regulations and Licensing Requirements


Each state's Department of Insurance determines the licensing requirements for Insurance Agents and brokers, which are designed to ensure that professionals have the necessary knowledge and expertise to serve their clients effectively.  These requirements are not determined by individual insurance companies or wholesalers.

In most states, selling insurance without the proper license can result in severe criminal penalties, including fines and potential imprisonment.  Additionally, selling insurance without a license is excluded from an Insurance Agent's Errors & Omissions Insurance policy, leaving agents (and Motor Carriers) unprotected in the event of a claim.
